Learn how to assess and analyze conflicts in the business and legal setting to determine if and how to best resolve them. Sometimes conflicts can be anticipated and a system, policy or agreement can put in place in advance to resolve them. Other times a colleague, business partner or client confronts us with a conflict. In either of these situations it is important to be aware of your choices and potential courses of action.
This session will cover what questions to ask to gather information, how to assess what process is best suited to the issues and personalities involved. We will also discuss how disputes enter into ADR process and an overview of dispute system design and issues to consider in crafting dispute resolution clauses and considerations of ad hoc and administered dispute resolution processes. The workshop will use several scenarios to walk through the choices, issues and ethical obligations.
